Terms of Service

These Terms of Service ("Terms") govern your access to and use of Covenant ("Covenant," "we," "us," or "our"), a platform for creating, sending, and managing credit applications. By creating an account or otherwise using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.

If you use Covenant on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.

Covenant lets dealers and brokers generate branded, single-use links that customers use to complete and electronically sign credit applications. A completed application is available to the sending organization for a limited access window, after which access is closed automatically.

We may add, change, or remove features over time. We may also suspend or discontinue the service, in whole or in part, with reasonable notice where practical.

You must provide accurate account information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use.

You must be at least 18 years old and legally able to enter into these Terms to use Covenant.

You agree to use Covenant only for legitimate credit application activity that you are authorized to conduct. You will not misuse the service, attempt to gain unauthorized access to it, interfere with its operation, or use it to collect information you have no lawful basis to collect.

You are responsible for obtaining any consents required to collect and process applicant information through the service, and for complying with all laws that apply to your handling of that information.

Applicants submit sensitive personal and financial information through Covenant. You agree to handle that information responsibly, use it only for the purpose for which it was collected, and comply with applicable privacy, data protection, and consumer credit laws.

We apply access controls, expiring access windows, and other safeguards described in our documentation. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Covenant supports electronic signature of credit applications. You acknowledge that electronic signatures captured through the service are intended to be legally binding to the extent permitted by applicable law, and that you are responsible for confirming that electronic signatures are appropriate for your use.

Access to certain features may require a paid plan. Fees, billing intervals, and plan limits are described at the time of purchase. Unless stated otherwise, fees are non-refundable. We may change pricing on a going-forward basis with reasonable notice.

Covenant and its underlying software, design, and content are owned by us and our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these Terms. You retain ownership of the data you and your applicants submit.

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Covenant will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the amounts you paid us in the twelve months before the event giving rise to the claim.

You may stop using the service at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe it is necessary to protect the service, its users, or applicant data. On termination, your right to use the service ends, and applicable data retention and expiry rules continue to apply.

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the service after the changes take effect constitutes acceptance of the revised Terms.
